How the Texas Lemon Law Works
Texas law offers strong protections for consumers under Texas Occupations Code Chapter 2301, especially Subchapter M (Warranties: Rights of Vehicle Owners). When a vehicle defect covered by the manufacturer’s warranty cannot be fixed after a reasonable number of repair attempts, you’re entitled to recourse — either a refund, replacement, or remedy.The Texas DMV administers the Lemon Law process, including consumer complaints and hearings.
Which Vehicles Are Covered?
Texas Lemon Law covers:
- New vehicles (cars, trucks, SUVs) and demonstrator vehicles not previously titled
- Motorcycles, all-terrain vehicles (ATVs), motor homes, towable recreational vehicles (TRVs)
- Defects covered under an original manufacturer warranty
Texas law does not protect:
- Repossessed vehicles
- Non‑travel trailers, boats, or farm equipment
- Defects that do not substantially impair the use, value, or safety of the vehicle (e.g. minor rattles)
Used vehicles generally aren’t covered unless the original warranty still applies and the defect was first reported under that warranty.
When Does a Defect Qualify as a “Lemon”?
Texas law sets out three common “prongs” (tests) under which a vehicle is presumed a lemon if one of them is met:
- Four‑Times Test: The same defect was unsuccessfully repaired four or more times within the first 24 months or 24,000 miles (whichever comes first).
- Serious Safety Hazard Test: A life-threatening defect that remains after two repair attempts.
- 30‑Day Test: The vehicle has spent a cumulative total of 30 or more days out of service for repair under warranty.
If you satisfy one of these, the law rebuttably presumes your vehicle is a lemon — though manufacturers can attempt to rebut by showing otherwise.
What Remedies Are Available?
If your vehicle qualifies under Texas Lemon Law, you may be entitled to:
- Refund (Buyback): The manufacturer must repurchase the vehicle, including taxes, registration, and fees, minus a “reasonable allowance for use” (mileage deduction).
- Replacement: The manufacturer may replace your vehicle with a comparable one, all defects corrected.
- Repair: If still feasible, the manufacturer must repair the defect permanently or correct it.
- Reimbursement: For incidental and consequential expenses you incurred due to the defect (rental, towing, loss of use).
- Attorney’s Fees & Costs: If you prevail, the manufacturer may be required to pay your legal fees and court costs.
